Employer Responsibilities
- Form an Internal Committee (IC) Mandatory if the organization has 10 or more employees.
- Create a POSH Policy
- Clearly define sexual harassment, complaint process, and disciplinary actions.
- Conduct Awareness & Training
- Consent regular training programs for employees and IC members.
- Display POSH Notices
- Display posters about sexual harassment prohibition and complaint details at the workplace.
- Provide Safe Working Environment Ensure a workplace free from harassment,
- Assist in Complaint Process
- Provide necessary facilities for the IC to conduct the inquiry.
- Take Action on IC Recommendations
- Implement disciplinary action within 60 days after receiving the report.
- Include POSH Details in Annual Report
- Submit the number of cases and actions taken to the District Officer.
- Maintain Confidentiality
- Protect the identity of the complainant and details of the case.
Internal Committee (IC) Responsibilities
- The Internal Committee is responsible for receiving Complaints,
- Complaints made within 3 months of the incident must be accepted.
- Conduct Inquiry
- Investigate the complaint fairly and impartially.
- Provide Interim Relief
- Recommend temporary measures like leave, transfer, or reporting changes.
- Submit Inquiry Report
- Complete the investigation within 90 days.
- Recommend Action suggest disciplinary action if harassment is proven.
- Ensure Confidentiality
- Keep proceedings and identities confidential.
- Maintain Records
- Maintain all complaints and inquiry documents.
